Legal Separation


Obtaining a legal separation is similar to obtaining a divorce with the exception that it does not terminate the marriage. In a legal separation the Court has the same ability to issue orders regarding parental rights over children, orders for their support, spousal support and the allocation of property and debts. However, unlike a divorce, there is no mandatory period of residency within Ohio before an action can be filed and spousal support, if ordered, is always modifiable.

Depending upon a party's situation, there may be a number of benefits to seeking a legal separation instead of terminating the marital relationship. These benefits include: retaining the dependent status for the purpose of maintaining health insurance coverage, the retention of spousal benefits for disability Medicare and/or retirement under the Social Security law, adherence to religious beliefs that preclude a divorce or managing the rights and responsibilities of the parties while maintaining the possibility of reconciliation.
